Целью исследования является анализ эффективности и проблем в реализации Федерального закона от 23 ноября 2009 г. № 261-ФЗ «Об энергосбережении и о повышении энергетической эффективности, и о внесении изменений в отдельные законодательные акты Российской Федерации» и Постановления Правительства РФ от 18 августа 2010 г. № 636 «О требованиях к условиям энергосервисного договора (контракта) и об особенностях определения начальной (максимальной) цены энергосервисного договора (контракта) (цены лота)» в отрасли электроэнергетики на Дальнем Востоке. Научной новизной является анализ проблем, возникающих при реализации энергосервисных контрактов в электроэнергетических предприятиях Дальнего Востока, которые мало изучены в силу особенностей предприятий поставщиков энергоресурсов и односторонности Федерального закона «Об энергосбережении…», ограниченного потребителями энергоресурсов. Все изолированные энергосистемы Дальнего Востока, включая северную территорию Якутии, Чукотку, Сахалин, Магадан, Камчатский край остались вне зоны реформирования. Основной проблемой в электроэнергетике является ограниченность тарифами, которая служит сдерживающим фактором развития предприятий, их модернизации и реконструкции, которые необходимы для снижения себестоимости выработки электроэнергии. Одним из эффективных и доступных механизмов является реализация энергосервисных контрактов на взаимовыгодных условиях для инвесторов и заказчиков. Однако недостатки и упущения в законодательстве, а также проводимая политика государства по развитию Дальнего Востока могут стать сдерживающими факторами в реализации энергосервисных контрактов в отрасли электроэнергетики. Авторами проведен анализ энергосервисных контрактов, проводимых в Якутии, изучены проблемы и возможные механизмы по их решению. Исходя из вышеизложенного, предлагается создать уполномоченные центры в регионах Дальнего Востока для координации действий заказчиков, инвесторов и энергокомпаний, например, в региональных Управлениях Федеральной антимонопольной службы.
The purpose of the study was to analyze the effectiveness and problems in the implementation of the Federal Law of November 23, 2009 No. 261-FZ «On energy saving and improving energy efficiency, and on amending certain legislative acts of the Russian Federation» and Decree of the Government of the Russian Federation of August 18, 2010 No. 636 «On requirements to the terms of the energy service contract and on the specifics of determining the initial (maximum) price of the energy service contract (lot price)» in the power industry in the Russian Far East. The scientific novelty is the analysis of problems arising in the implementation of energy service contracts in electric power enterprises in the Russian Far East, which have been little studied due to the peculiarities of enterprises of energy suppliers and the unilateral nature of the Federal Law «On Energy Conservation» limited by energy users. All isolated energy systems of the Russian Far East, including the northern territory of Yakutia, Chukotka, Sakhalin, Magadan, and Kamchatka Territories, remained outside the reform zone. The main problem in the electricity industry is the limited tariffs, which serve as a deterrent to the development of enterprises, their modernization and reconstruction, which are necessary to reduce the cost of electricity generation. One of the effective and accessible mechanisms is the implementation of energy service contracts on mutually beneficial terms for investors and customers. However, those who have shortcomings and omissions in the legislation, as well as the state’s policies for the development of the Russian Far East, can become a deterrent in the implementation of energy service contracts in the electricity industry. The authors analyzed energy service contracts signed in Yakutia, studied problems and possible mechanisms to solve them. Based on the above, it is proposed to create authorized centers in the regions of the Russian Far East to coordinate the actions of customers, investors and energy companies, for example, in regional departments of the Federal Antimonopoly Service.
